These Terms & Conditions ("Terms") govern your use of the Simmy app and website (together, the "Service"), operated by Simmy ("we", "us", "our"). By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. What Simmy is
Simmy is a reseller of eSIM data plans. We do not operate a mobile network ourselves; we resell mobile data connectivity supplied by third-party eSIM and network providers. When you buy a plan, you receive an eSIM profile (delivered as a QR code or one-tap installation) that you install on a compatible, carrier-unlocked device. Plans provide data only — they do not include voice calls or SMS unless the specific plan description states otherwise.
3. Your account
You sign in with your email address. We send a one-time code to that address to verify it; there is no password to remember. You are responsible for keeping access to your email account secure, and for all activity that occurs under your Simmy account. You must provide a real, working email address so we can deliver purchase confirmations and support replies.
4. Eligibility and device compatibility
You must be old enough to form a binding contract in your country of residence. eSIMs only work on devices that support eSIM and are not carrier-locked. It is your responsibility to confirm your device is compatible before purchasing. Some plans are restricted to specific countries or regions, as described on the plan page.
5. Payments and pricing
Prices are shown in the app before you confirm a purchase, and the total you see is the total you pay for that plan. Payments are processed by a third-party payment gateway; we do not store full card details on our servers. You authorise us (via that gateway) to charge the displayed amount for the plan you select. Taxes or fees may apply depending on your location and will be shown where applicable.
6. Activation, validity, and refunds
An eSIM plan typically activates on first network attachment or on a fixed start date, as stated on the plan. Validity windows and data allowances are described per plan and begin according to those terms.
- Before installation: if you have not yet installed or activated the eSIM profile, you may request a refund and we will assess it in good faith.
- After installation or activation: because eSIM profiles are provisioned with our upstream provider once issued, an installed or activated plan is generally non-refundable, except where required by applicable law or where the plan is faulty and cannot be made to work.
- Coverage caveats: connectivity depends on the underlying mobile networks, local conditions, and your device. We cannot guarantee uninterrupted service or any particular speed in every location.

7. Acceptable use
You agree not to use the Service to:
- break any applicable law or the terms of the underlying network;
- resell, share, or commercially redistribute a plan without our written permission;
- send spam, malware, or otherwise abuse the network;
- attempt to circumvent fair-use, data, or geographic limits; or
- interfere with, probe, or attack the Service or its infrastructure.
We may suspend or terminate access if we reasonably believe these Terms or fair-use limits have been breached.
8. Service availability
We work to keep the Service available, but we provide it "as is" and "as available". Plans, prices, and destinations may change, and we may add, modify, or withdraw plans at any time. We are not liable for indirect or consequential losses arising from your use of the Service, and our total liability for any claim relating to a plan is limited to the amount you paid for that plan, to the extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded by law.
9. Privacy
Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.
10. Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by an updated effective date at the top of this page. Continued use of the Service after a change means you accept the updated Terms.
